Proses Pembentukan Peraturan Daerah Kota Sawahlunto Nomor 8 Tahun 2019 Tentang Penyelenggaraan Administrasi Kependudukan

Abstract

The authority to make Regional Regulations is a concrete manifestation of the implementation of the autonomy rights of a region and one of the means of implementing regional autonomy. In the drafting of regional regulations, those compiled by the proposing OPD will then be harmonized by the Law and Human Rights Division. In the City of Sawahlunto, the process of establishing regional regulations regarding the Implementation of Population Administration has not been in accordance with the applicable regulations. This then becomes the background for the question in this research, namely: what is the process of forming the Sawahlunto City Regional Regulation Number 8 of 2019 concerning the Implementation of Population Administration? and how the implementation of the role of the Law and Human Rights Division and the Department of Population and Civil Registration in the formation of the Regional Regulation of the City of Sawahlunto Number 8 of 2019 concerning the Implementation of Population Administration. The research method used is legal research using a sociological juridical approach and then analyzed qualitatively and presented descriptively. Based on the results of the research, it is known that the process of forming the Regional Regulation of the City of Sawahlunto Number 8 of 2019 concerning the Implementation of Population Administration is not in accordance with the applicable regulations and there are various obstacles including budget limitations, lack of understanding and awareness of the proposing OPD, the absence of functional design staff for civil servants at Sawahlunto City Government, as well as the lack of coordination between the parties involved in the process of forming the regional regulation. The implementation of the role of the Legal and Human Rights Section of the Sawahlunto City Regional Secretariat related to the regional regulation formation process exceeds the Tupoksi, while the role of the Population and Civil Registration Service, especially in the Field of Population Administration Services, is not yet in accordance with the Tupoksi.
